Abstract:
The compliance of the law is influenced by various factors, one of which is the culture of the community. The purpose of this study is to see the essence of legal culture in Indonesian society. The method used in this research is a normative legal method by reviewing the legislation and principles, and norms that apply to the issue. The result is we offers three indicators that can be used as a guideline for the improvement of the legal culture, namely legal obidient, social moral, and legal awareness. However, the fulfillment of these three indicators is constrained by the way law is conduct in Indonesia, which is still dominated by “law by regulations” rather than “law by reasoning”. Law by regulations is law in its lowest form, which is to run the law by applying what is written in the text in a straightforward manner. This method of conducting the law will lead to legal obidient, but it will not foster the moral of the society needed to achieve legal awareness. In this case, law with reasoning and common sense is an important key to building legal awareness.
