The decision of constitutional court Mahkamah Konstitusi (MK) which says that the chosen legislative candidate based on the number of sequence has the majority of voices.This change of system stimulates the existence of selling and buying voices. In section 1338 (1) KUHPerdata which states that the agreement of selling and buying voices is as law if agreement occurs. However, to decide the validity of such agreement, it should be measured by conditions stated in section 1320 KUHPerdata. Selling and buying voice in elections comply with conditions but it collides with law Number 10 year 2008 about legislative election section 84 part (1). Evading the objective condition in selling and buying voices will cause the agreement to be invalid. |
