Perlindungan Hukum Terhadap PetaniI Perkebunan Kelapa Sawit dalam Program Kemitraan Inti Plasma

Abstract

The plasma core partnership program in its implementation has many shortcomings. Plasma estate management in partnership with the nucleus has a very diverse management status. Some are individual and some are under group management. Often with many shortcomings in its implementation, the tendency of unfavorable conditions is on the part of farmers. The issue of the problem in this study is how is legal protection for oil palm smallholders in the plasma core partnership program? This type of research is juridical-normative research, which is research focused on examining the application of legal norms or norms in positive law as well as legal principles and legal theory. The results of this study indicate that legal protection in the core-plasma partnership is based on the clause of the agreement keeping in mind the legal principles of the contract pacta sunt servanda. So in this case to provide strong protection and form a balanced position of the parties, then the contract or agreement of the core-plasma partnership should be stated in the form of a notarial deed.
