Kebijakan Hukum Penataan Ruang Kawasan Pertanian dalam Upaya Perlindungan dan Pengelolaan Terhadap Lahan Pertanian di Lahan Basah dalam Perspektif Pembangunan Berkelanjutan

Abstract

The research discussed the public policy of spatial planning of agricultural areas in wetlands in the perspective of sustainable development, (which optimized human utilities and resources by harmonizing natural resources with humans in development. This study aims to determine the spatial planning policy of agricultural areas on wetlands in the perspective of sustainable development. The method used in the research is normative juridical, namely research focused on studying the application of norms in positive law, based on library research that uses legal material. The results are, in order to protect agricultural areas on wetlands in South Kalimantan, the government has made several regulations including: the 1945 Constitution, Law Number 5 Year 1960 on Basic Regulation of Agrarian Principles; Law Number 26 Year 2007 on Spatial Planning; Law Number 41 Year 2009 on Protection of Sustainable Agricultural Food and Supporting Regulations, and South Kalimantan Province Regional Regulation Number 9 Year 2015 on the Spatial Plan of South Kalimantan Province for 2015-2035.
